Rubbish Collection Canary Wharf Service Terms and Conditions

These Terms and Conditions set out the agreement between you and Rubbish Collection Canary Wharf for the provision of waste and rubbish collection services. By placing a booking, confirming a quotation or allowing our operatives to collect waste from your premises, you agree to be bound by these Terms and Conditions.

1. Definitions

In these Terms and Conditions:

Customer means the individual, business or organisation requesting our rubbish collection or waste removal services.

Company means Rubbish Collection Canary Wharf, the provider of waste and rubbish collection services.

Services means any waste collection, rubbish removal, clearance, loading, transportation or related services supplied by the Company.

Premises means the address or location at which the Services are to be provided.

Waste means any rubbish, junk, refuse or materials that the Customer requests the Company to remove, subject to any exclusions set out in these Terms and Conditions.

2. Scope of Services

The Company provides waste and rubbish collection services, including household waste clearances, commercial waste collections, bulky item removal and general rubbish removal within its operational service area. The exact scope of the Services to be provided will be set out in the booking confirmation or quote issued to the Customer.

The Company reserves the right to refuse to collect any item that is unsafe, prohibited by law, contains hazardous substances or is otherwise unsuitable for collection or transport. The Customer is responsible for informing the Company in advance of any unusual or bulky items that may require special handling.

3. Booking Process

Bookings for rubbish collection and waste services may be made by telephone, email or other booking channels made available by the Company. At the time of booking, the Customer will be asked to provide accurate information including:

1. Name and contact details.

2. Collection address and access details.

3. Description, estimated volume and type of waste.

4. Preferred date and time window for collection.

The Company will provide an estimated price based on the information supplied. This estimate may be revised if, upon arrival, the volume, nature or location of the waste differs materially from the description initially provided by the Customer.

Bookings are subject to availability and are not confirmed until the Company issues a booking confirmation or agrees a collection time with the Customer. The Company may, at its discretion, decline any booking request.

4. Access and Parking

The Customer must ensure that there is safe, suitable and lawful access to the Premises for the Company’s staff and vehicles at the agreed collection time. This includes ensuring that:

1. Any necessary parking or access permits are arranged in advance.

2. The collection route is free from obstruction and hazards.

3. The waste is clearly identified and ready for removal, unless the Company has agreed to provide a loading or internal clearance service.

Where parking charges, congestion charges or other access fees apply, these may be added to the final invoice if not already included in the initial quotation.

5. Customer Obligations

The Customer agrees to:

1. Provide complete and accurate information about the waste to be collected.

2. Comply with all applicable waste regulations and not request the Company to remove prohibited or hazardous materials unless this has been expressly agreed and properly arranged.

3. Ensure that the waste presented for collection does not contain personal data or confidential documents, unless it is specifically agreed that secure disposal will be arranged.

4. Be present at the Premises at the time of collection or arrange for an authorised representative to grant access and confirm the waste to be removed.

If the Customer fails to meet these obligations, the Company may charge additional fees for wasted journeys, waiting time or extra labour, or may decline to carry out the Services.

6. Pricing and Payments

Prices are generally quoted based on the estimated volume, weight and nature of the waste, along with access conditions and other factors relevant to the collection. All prices will be communicated to the Customer before the Services are carried out, either as a fixed quote or as an estimate subject to confirmation on site.

The Company reserves the right to vary the price if the actual waste collected differs from the original description, if access conditions are more difficult than reported, or if additional labour, time or vehicles are required. In such cases, the Customer will be informed of any price adjustments before the work continues.

Payment terms will be confirmed at the time of booking. Unless otherwise agreed, payment is due either in advance or immediately upon completion of the Services. The Company may accept payment by cash, card, bank transfer or other methods as notified to the Customer.

For commercial Customers, the Company may, at its discretion, agree written credit terms. Where credit is granted, invoices are payable within the timeframe stated on the invoice. The Company reserves the right to charge interest and reasonable recovery costs on overdue invoices in accordance with applicable UK law.

7. Cancellations and Amendments

The Customer may cancel or amend a booking by contacting the Company as soon as possible. The following cancellation and amendment terms will usually apply:

1. If the Customer cancels a booking more than 24 hours before the scheduled collection time, no cancellation fee will normally apply.

2. If the Customer cancels less than 24 hours before the scheduled collection time, the Company may charge a cancellation fee to cover administrative costs, allocated resources and any expenses incurred.

3. If the Customer is not present, denies access or otherwise prevents the Company from carrying out the Services at the agreed time, this may be treated as a late cancellation and a similar fee may be charged.

Any request to change the date, time or details of a booking will be subject to availability. The Company will use reasonable efforts to accommodate amendments but cannot guarantee that changes can be made. Additional charges may apply if the amendment results in extra costs for the Company.

8. Waste Types and Prohibited Materials

The Company operates in compliance with UK waste management regulations. Certain types of waste are restricted or require special handling. Unless expressly agreed and properly arranged in advance, the Company will not collect:

1. Hazardous waste such as chemicals, solvents, asbestos, clinical waste or toxic substances.

2. Pressurised containers, gas bottles or cylinders.

3. Large quantities of liquids, oils, fuels or paints.

4. Materials containing asbestos or suspected asbestos-containing materials.

5. Any items that are illegal to transport, store or dispose of.

The Customer is responsible for informing the Company in advance if any waste may fall into a restricted or hazardous category. If, upon arrival, the Company identifies prohibited materials, it may refuse collection of those items and may charge a fee for attendance and any partial work carried out.

9. Waste Handling and Disposal

The Company will handle, transport and dispose of collected waste in accordance with applicable UK laws and regulations. This includes using appropriate licensed facilities, transfer stations and recycling centres as required.

Once the waste has been collected, ownership and responsibility for it generally pass to the Company, subject to compliance with all applicable regulations and except where specific arrangements have been made with the Customer. The Company will use reasonable efforts to recycle or recover waste where practicable, but cannot guarantee that any particular item will be recycled or re-used.

10. Service Times and Delays

The Company will use reasonable endeavours to attend the Premises within the agreed time window. However, all times are estimates and may be affected by traffic, weather, operational issues or circumstances beyond the Company’s reasonable control.

If the Company expects a significant delay, it will seek to contact the Customer as soon as reasonably practicable to agree an alternative time or reschedule the booking. The Company will not be liable for any loss, cost or inconvenience arising from delays that are outside its reasonable control.

11. Liability and Limitations

The Company will carry out the Services with reasonable care and skill. If the Customer believes that the Services have not been provided in accordance with this standard, the Customer must notify the Company as soon as possible and, in any event, within a reasonable period after the collection.

The Company’s total liability to the Customer arising out of or in connection with the Services, whether in contract, tort or otherwise, shall be limited to the total price paid or payable by the Customer for the specific collection giving rise to the claim.

Nothing in these Terms and Conditions limits or excludes liability for death or personal injury caused by negligence, fraud or fraudulent misrepresentation, or any other liability that cannot be excluded under UK law.

The Company will not be liable for any indirect or consequential loss, loss of profit, loss of business, loss of data or damage to reputation arising from the provision or non-provision of the Services.

12. Damage to Property

The Customer must notify the Company of any alleged damage to property caused by the Company’s staff during the performance of the Services as soon as reasonably practicable and, in any event, within 48 hours of completion of the collection.

The Company will investigate any such report and may request evidence or an opportunity to inspect the alleged damage. Where the Company is found to be at fault, its liability will be limited to the reasonable cost of repair or replacement, taking into account fair wear and tear and the condition and age of the property prior to the incident.

13. Insurance

The Company will maintain appropriate insurance in relation to its rubbish collection operations, including public liability cover as required by law and good industry practice. Details of insurance cover are available on request.

14. Data Protection and Privacy

The Company will collect and process personal data only to the extent necessary to manage bookings, provide the Services, process payments and handle customer communications. Personal data will be handled in accordance with applicable UK data protection laws.

The Customer is responsible for ensuring that any waste presented for collection does not contain personal or confidential information unless secure destruction has been specifically agreed. The Company will not be responsible for any loss or misuse of data contained within items placed in general rubbish or mixed waste collections.

15. Complaints and Dispute Resolution

If the Customer is dissatisfied with any aspect of the Services, they should contact the Company as soon as possible, providing full details of the issue, the date of collection and any relevant evidence.

The Company will investigate complaints and aim to respond within a reasonable timeframe. Where appropriate, the Company may offer a remedy such as a partial refund, re-attendance to complete work or other proportionate resolution, without any admission of liability.

16. Force Majeure

The Company will not be in breach of these Terms and Conditions or otherwise liable for any delay in performance or failure to perform its obligations where such delay or failure results from events, circumstances or causes beyond its reasonable control. These may include, but are not limited to, extreme weather conditions, traffic disruption, industrial action, accidents, emergencies, legal restrictions or failure of third-party suppliers.

17. Variations to Terms

The Company may amend or update these Terms and Conditions from time to time. The version in force at the time of booking will apply to that booking. Any material changes will be made available through the Company’s usual communication channels.

18. Governing Law and Jurisdiction

These Terms and Conditions, and any dispute or claim arising out of or in connection with them or the Services, shall be governed by and construed in accordance with the laws of England and Wales.

The courts of England and Wales shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the Services provided by Rubbish Collection Canary Wharf.

19. Entire Agreement

These Terms and Conditions, together with any written quotation or booking confirmation issued by the Company, constitute the entire agreement between the Customer and the Company in relation to the provision of rubbish collection and waste removal services. No other terms, representations or understandings shall have any effect unless expressly agreed in writing by the Company.

By making a booking, confirming a quotation or allowing collection to proceed, the Customer acknowledges that they have read, understood and agree to be bound by these Terms and Conditions.
